European Court of Justice rules against Italy

The ECJ said the system used by the Italian Government until 2004 to award sports betting licenses without a competitive bidding process was illegal. “Italy failed to fulfil its obligations under Articles 43 (freedom of establishment) and 49 (freedom to provide services) of the EC Treaty. In particular, the Italian authorities infringed the general principle of transparency and the obligation to ensure a sufficient degree of advertising,” the European Court of Justice said.
